GENERAL ISSUES REGARDING ENFORCED DISAPPEARANCE AS A FORM OF CRIMES AGAINST HUMANITY

The paper deals with the analysis of two key and initial issues related to the enforced disappearance of a person as a form of crime against humanity - the historical development of this institution and the sources of law regarding this crime. In this sense, the paper is divided into two parts. In the first part, the historical development of the institute from the Nuremberg trials until today is analyzed. The second part refers to the sources of law with regard to this crime. The paper chronologically cites and analyzes the sources of both international criminal law and international public law and human rights law, which have a decisive influence on this incrimination and its development.
