EXECUTION PROCEDURE ON MOVABLE THINGS OF EXECUTORS IN THE REPUBLIC OF SERBIA

Abstract

The subject of this paper is the enforcement procedure on the movable property of the executor in the Republic of Srpska. It is a special procedure for the collection of the claimant's monetary claim. Legal provisions and court practice related to the mentioned procedure are analyzed, all with the aim of creating a complete picture of the mentioned procedure. Although before the courts in the Republika Srpska, execution on movable property is the most frequently proposed means of execution, it is at the same time the most ineffective means of execution, and the author will specifically deal with the causes of ineffectiveness of the procedure. In the final part of the paper, we try to point out all the shortcomings of this procedure and give some suggestions de lege ferenda.
