Abstract

The paper analyzes the protection of women and motherhood in the labor legislation of the Federation of Bosnia and Herzegovina. For biological, social and humane reasons, the protection of motherhood is achieved at several levels, with the entire area of social protection of families with children mainly being the responsibility of the entity. The situation is particularly specific in the Federation of Bosnia and Herzegovina, where this area is under the joint jurisdiction of the federal and cantonal authorities. This creates certain difficulties in regulating, realizing and financing the rights of working mothers-in-birth. The paper points out the unevenness of solutions in the cantonal regulations regarding the realization of the mentioned rights, and thus also the unequal position of women, considering the canton in which they live. The paper provides an overview of the most important international documents that regulate issues of maternity protection and points out the importance and need for harmonizing domestic regulations with international standards. Starting from the fact that the area of protection of families with children is an area of special social interest, it is necessary to undertake activities aimed at improving the situation in this area.
