SUBJECT OF COMMON PROPERTY OF THE SPOUSES

During the duration of the marriage union, not only a personal relationship is established between the spouses, but also a property relationship. The subject of the study of this work is the differentiation of the property values of the joint property of the spouses in relation to their separate property. Although the legislator has decisively determined in the relevant provisions of the Family Law what is included in the common property of the spouses, certain dilemmas arise in practice. However, the very existence of the institution of joint property of spouses, as well as the legal assumption about dividing it into equal parts, are facts that are indisputable and generally accepted in modern law and represent the heritage of civilization. In the continuation of the work, issues related to the legal nature and elements of common property will be dealt with in more detail, and which things and rights are included in the common property fund.
