CO-EXECUTION AND THEORY OF AUTHORITY OVER THE ACT

In modern criminal law, the material-objective theory, better known as the "theory of power over the crime", stands out as the prevailing theoretical understanding of co-perpetrator participation in the execution of a criminal offense. It is about reflection that is positioned between the theory of dolus and the formal-objective theory. In the paper, the author gives an overview of the basic assumptions on which the understanding is based, and briefly reviews its influence on certain legal solutions on co-perpetration.
