THE PRACTICE OF THE CONSTITUTIONAL COURT OF BOSNIA AND HERZEGOVINA - THE RIGHT TO A FAIR TRIAL
Abstract
There is a violation of the right to a fair trial from Article II/3e) of the Constitution of Bosnia and Herzegovina and Article 6 paragraph 1 of the European Convention for the Protection of Human Rights and Fundamental Freedoms in the case when the regular courts are deciding on when the appellant has the status of a pending employee, and , in connection with that, on other rights from the labor law relationship, apparently arbitrarily applied positive legal regulations, i.e. Article 143 of the Labor Law.
